If you have invented something original (that is an object or machine), or a way to make that something (that is, a process), whether it be mechanical, electrical, chemical or software or a combination of these or just a new combination of old elements which you have combined to interact in an innovative and useful way, then your invention may be protectable by means of a patent.

Patents exclude your competitors from your invention.  Patents must be applied for either by filing a patent application in each country of interest or initially, an international or Patent Cooperation Treat (PCT) patent application.  Patents which are issued or still pending may be licenced or sold to others. Patents provide you a monopoly on making, using and selling the invention protected by your patent. Your invention is only protected by your issued patent if you enforce your patent rights. Thus if someone copies your invention and there is infringement of your patent, you or any subsequent owner by assignment of your patent have to enforce the patent against such infringement by a cease and desist demand and/or litigation in court for patent infringement.

Trademarks are a valuable asset.  Trademarks exclude your competitors from using your business name or logo.  Trademark may be registered with the Trademark office of the government to obtain full rights. A trademark registration must be applied for by filing a trademark application, trademark registrations which are issued or still pending may be licenced or sold to others.  Your trademark is only protected by an issued trademark registration if you take steps to patrol your trademark rights. Thus if someone copies your trademark and there is infringement of your trademark rights, you or any subsequent owner by assignment of the trademark have the right to enforce the trademark rights against such infringement by a cease and desist demand and/or litigation in court for trademark infringement.
